Introduction

1. These Terms and Conditions (Terms), together with any quote, proposal or additional documents provided by Fixly Plumbing (we, us, our), govern your use of our website
   www.fixlyplumbing.com.au (our Site) and the plumbing services provided by us, and form a legally binding agreement between you and us.
2. These Terms are important and should be read carefully before engaging our services. If you have any questions or require clarification, you must contact us in writing at

3. Subject to any later written agreement entered into between you and us, these Terms constitute the entire agreement and supersede all prior discussions, representations, negotiations and understandings.
4. You confirm that you have not relied on any statement, promise or representation that is not expressly set out in these Terms.
   
   

1. Acceptance of Terms

1. Before commencing any services, we will provide you with these Terms, a written quote and any other documents required by law.
2. All plans, specifications, drawings and agreed variations form part of the binding agreement between the parties.
3. By accepting our Quote, paying a deposit or allowing us to commence work, you acknowledge that you have read, understood and agreed to be bound by these Terms.
4. You are entitled to receive a copy of the accepted Quote and these Terms within five business days of acceptance.
   
   

2. Quality of Work

1. All services will be carried out with due care and skill and in accordance with applicable Australian Standards, the Building Code of Australia and all relevant laws.
2. Works will comply with any relevant development approvals, construction certificates and statutory requirements.
3. To the extent permitted by law, our liability may be limited where any failure arises solely from designs, specifications or instructions provided by you.
   
   

3. Variations

1. Any change to the scope of works must be agreed to in writing by both parties before the variation is carried out.
2. Variations may result in additional fees and adjustments to the estimated completion timeframe.
3. Variations may be required due to unforeseen site conditions, safety issues, or statutory or regulatory requirements.
   
   

4. Services

1. We provide residential and commercial plumbing services throughout Brisbane and surrounding areas.
2. Our services include repairs, installations, maintenance, hot water systems, gas works, leak detection, pipe relining, blockages, renovations and emergency plumbing.
3. We may take photographs and prepare reports before, during and after completion of works for quality control, compliance and record-keeping purposes.
4. Completion dates provided are estimates only and may change due to circumstances beyond our control.
   
   

5. Fees

1. Fees for services are set out in the Quote provided to you and accepted prior to commencement.
2. A call-out fee may apply where you choose not to proceed with the quoted works.
3. All fees are exclusive of GST unless stated otherwise.
   
   

6. Payments

1. Full payment is due upon completion of the services unless otherwise agreed in writing.
2. A deposit may be required prior to commencement and is non-refundable once work has started.
3. Failure to pay amounts owing may result in suspension or termination of services.
   
   

7. Progress Payments (Works Over $20,000)

1. Progress payments must be made within five business days of each completed stage as outlined in the Quote.
2. Where a lender is involved, their payment terms may apply instead.
   
   

8. General Contract Conditions

1. We will comply with all statutory warranties and legal obligations applicable to the services.
2. The contract price includes all work reasonably necessary to complete the agreed scope.
   
   

9. Cooling-Off Period

1. For works over $20,000, you may have a statutory cooling-off period under applicable legislation.
2. Any notice of cancellation must be provided in writing.
   
   

10. Insurance

1. We maintain all legally required insurances, including home building insurance where applicable.
2. Evidence of insurance will be provided upon request prior to commencement.
   
   

11. Statutory Warranties

1. All work will be completed with due care and skill.
2. Materials supplied will be suitable and fit for their intended purpose.
   
   

12. Disclaimer

1. Services are provided on an “as-is” and “as-available” basis to the extent permitted by law.
2. We are not responsible for indirect, incidental or consequential losses.
   
   

13. Your Obligations

1. Provide clear access, utilities and a safe working environment.
2. Ensure pets are restrained and fragile items are removed from work areas.
3. Provide accurate and complete information relevant to the services.
   
   

14. Confidentiality

1. Both parties must keep confidential information private unless disclosure is required by law.
2. This obligation survives termination of these Terms.
   
   

15. Intellectual Property

1. All website content, branding and documentation remain our intellectual property.
2. Unauthorised use or reproduction is prohibited.
   
   

16. Suspension and Termination

1. We may suspend or terminate services for breach or non-payment.
2. Refunds are provided only as required under Australian Consumer Law.
   
   

17. Liability

1. Our liability is limited to the amount paid for services where permitted by law.
2. We exclude liability for indirect or consequential loss.
   
   

18. Force Majeure

1. We are not liable for delays caused by events beyond our reasonable control.
   
   

19. Dispute Resolution

1. Disputes must first be raised in writing.
2. Mediation may be attempted before legal proceedings.
   
   

20. Governing Law

1. These Terms are governed by the laws of Queensland, Australia.
2. Queensland courts have exclusive jurisdiction.
